Can a real estate agent advertise on Zillow?

by AEA Staff

Most agents advertise on with websites or flyers. But recently, the United States Department of Justice issued a warning and notice about the illegal advertising by real estate agents on Zillow.
On January 25, 2016, the Department of Justice issued a warning and notice which federal law prohibits an individual providing real estate advice in certain capacities from advertising on Zillow.

The FTC regulations clearly states that a person who provides real estate advice in any of the following capacities:

-Living Near or Engaging in Real Estate Transactions in the State
-Undertaking to list, buy or sell real estate or to make mortgage loan or any agreement concerning real estate

-Offering services which assist the public in seeking or acquiring real estate can not advertise on Zillow

An agent is typically not allowed to advertise on Zillow, as Zillow is an internet-based real estate advertising platform. When a person does advertise on a site such as Zillow but is not authorized to provide real estate advice, they are in violation of federal law. If you are a property owner who lives in California and you need help with something such as seeking or releasing real estate, be sure to beware to not advertise on sites like Zillow.
